Terms of Service

Welcome to Pawfixly. These Terms of Service ("Terms") govern your access to and use of pawfixly.store (the "Site") and any purchase you make from us. The Site is operated by Pawfixly ("we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order on the Site. By placing an order, you confirm that the information you provide is accurate and complete and that you are authorized to use the payment method you provide.

Products and Descriptions

We do our best to describe and display our products accurately, including colors, sizes, and features. Because screens and devices display colors differently, and because suppliers sometimes make minor updates to product design or packaging, the item you receive may look slightly different from the images on the Site. If a product is not as described, you are covered by our Refund Policy.

Product information on the Site is for general information only and is not veterinary advice. If you have questions about your pet's health, behavior, skin, coat, or nails, please consult a licensed veterinarian.

Safe Product Use

Every pet is different. Please read and follow the instructions included with each product and use good judgment about what is suitable for your pet.

  • Battery-operated and interactive toys (such as self-rolling balls and automatic cat toys) are intended for supervised play. Watch your pet during use, especially the first few times, and remove the toy if your pet tries to chew it, swallow parts, or seems stressed.
  • Our toys are not chew toys. Check toys regularly for wear or damage and stop using any item that is cracked, broken, or has loose parts.
  • Keep batteries, charging cables, small parts, and packaging away from pets and children. Charge rechargeable products only as directed, using a suitable charger, and do not leave products charging unattended.
  • Use grooming tools, brushes, and nail grinders gently and according to the instructions. Trim or grind small amounts at a time, and stop if your pet shows signs of discomfort or irritation.
  • Clip-on LED lights are designed to make your pet easier to see in low light. They are an extra visibility aid and do not replace a secure leash, reflective gear, or careful attention near traffic.
  • Furniture guards, scratchers, mats, and similar accessories should be checked regularly and replaced when worn. Test adhesive products on a small, hidden area first, as results vary by surface.

You are responsible for supervising your pet and for using products appropriately for your pet's size, age, and temperament.

Pricing and Availability

  • All prices are listed in US dollars. Applicable sales tax is calculated at checkout.
  • Prices, products, bundles, and promotions may change at any time without notice. A price change will not affect an order that has already been confirmed, except for the errors described in the next section.
  • Products are subject to availability. If an item you ordered becomes unavailable, we will notify you and issue a full refund for that item.

Pricing and Typographical Errors

Despite our best efforts, a product may occasionally be listed with an incorrect price or description due to a typographical or technical error. If we discover an error, we reserve the right to correct it and to cancel any orders placed at the incorrect price, even after an order confirmation has been sent. If we cancel your order, we will notify you by email and issue a full refund to your original payment method.

Orders and Payment

Your order is an offer to purchase. We reserve the right to refuse, limit, or cancel any order, including orders that appear to be placed by resellers or that show signs of fraud. If we cancel an order after you have been charged, we will issue a full refund. Payments are processed securely through our payment providers, and you agree to pay all charges for your order at the prices in effect when the order was placed.

Discount Codes and Promotions

Discount codes and promotions are subject to the terms stated with each offer. Unless stated otherwise, discount codes cannot be combined, have no cash value, and cannot be applied to previous orders. We may end or change a promotion at any time.

Shipping, Returns, and Refunds

Shipping is handled according to our Shipping Policy, and returns and refunds are handled according to our Refund Policy, including our 30-Day Happy Pet Guarantee. Both policies are part of these Terms.

Accounts

If you create an account on the Site, you are responsible for keeping your login information confidential and for activity that occurs under your account. Please contact us right away if you believe your account has been used without your permission.

Your Content and Feedback

If you send us comments, ideas, photos, or other feedback, you allow us to use that feedback to improve our products and services. If you submit a product review, it must reflect your own genuine experience. We will not publish your name, photo, or review in our marketing without your permission.

Prohibited Uses

You agree not to use the Site to:

  • Break any law or violate the rights of others.
  • Submit false information or place fraudulent orders.
  • Upload viruses or malicious code, or interfere with the security or operation of the Site.
  • Scrape, copy, or collect content or data from the Site by automated means without our permission.
  • Harass, abuse, or harm other people.

Intellectual Property

All content on the Site, including text, graphics, logos, product images, and design, is owned by or licensed to Pawfixly and is protected by intellectual property laws. You may not copy, reproduce, or use this content for commercial purposes without our written permission.

Third-Party Services and Links

The Site is hosted on Shopify and may use other third-party services, such as payment processors and shipping carriers, or contain links to third-party websites. We are not responsible for the content, policies, or practices of third parties, and your use of their services is subject to their own terms.

Disclaimer of Warranties

Except as expressly stated in these Terms and in our Refund Policy, the Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that a product will suit every pet or produce a particular result. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Pawfixly and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the Site or our products. Our total liability for any claim related to a product or order will not exceed the amount you paid for that product or order. Some states do not allow the limitation or exclusion of certain damages, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Pawfixly and its owners, employees, and partners from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site or our products.

Governing Law and Disputes

These Terms are governed by the laws of the United States and the laws of the state where you live, to the extent they apply. If you have a concern, please contact us first through our contact form so we can try to resolve it informally. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction, as allowed by applicable law. Nothing in this section prevents you from bringing a claim in small claims court where you live, if it qualifies.

Your Consumer Rights

Nothing in these Terms is intended to limit any rights you have under applicable consumer protection laws that cannot be waived by agreement.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will be revised. Orders placed before a change are governed by the Terms in effect when the order was placed.

Severability and Entire Agreement

If any part of these Terms is found to be unenforceable, the rest will remain in effect. These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, make up the entire agreement between you and Pawfixly regarding your use of the Site.
